Welcome to Go Hamilton’s Drive School

These terms and conditions outline all of the rules, regulations and expectations for the use of Go Hamilton Drive School services and products. By accessing or using our services you accept these terms and conditions in full. If you do not accept or do not agree with any part of these terms you must not use our services. The terms and conditions of business under which driving instruction is provided are outlined below. These terms & conditions of business are a contract between the  (including the person or business responsible for the funding of the driving tuition) and all instructors working with Go Hamilton Drive school.

Our obligations to you

Driving instructors must abide by the professional code of conduct set by the DVSA which can be found here: DVSA Professional Code of Conduct

The instructor agrees to provide the client with a car which is legally roadworthy, has dual controls fitted, taxed, insured and holds a valid M.O.T. (where necessary).

The instructor will provide 2 hour lessons unless agreed otherwise prior to the lesson.

The instructor’s car will be well maintained, clean, tidy and presentable.

The client is offered a trial first lesson (at the normal rate) and is not obliged to continue with Go Hamilton Drive School if not wanting to.

The instructor will be respectful, courteous and polite, and will not use improper language.

The instructor will not make or receive calls or texts during the lesson unless in an emergency and when the car has been safely stopped in a safe place.

The instructor can reserve the right to not teach you and cancel any future lessons if we feel we are being discriminated against or abused verbally, in writing or any other form.

The instructor will be filming lessons if you do not wish to be filmed please make it known to the instructor during the first lesson.

The instructor will be uploading footage to social media sites, the instructor will ask before hand if it’s ok to do so, if not that’s ok and your lessons will not be shared.

Your obligations

The client must hold a current, valid driving licence that entitles them to drive in the UK. This driving license must be produced at the client’s first driving lesson and your instructor has the right to check it at any time. 

You must inform your instructor of any points, convictions, restrictions, bans or endorsements on your licence immediately.

The client must satisfy the requirements of medical fitness to drive, including compliance with the regulations for eyesight, being able read a number plate at the prescribed distance of 20.5 metres (67 feet) with glasses/contact lenses if normally worn. Where glasses or contact lenses are required in order to meet the eyesight requirement for driving, they must be worn at all times while the client is driving.

Every client learns at their own pace, and Go Hamilton Drive School and its instructors cannot guarantee or promise the number of hours or lessons required for a client to reach the necessary level of competence to pass the test and drive independently and safely. The time it will take the client will depend on their own abilities, how often they have lessons and the amount  of self-study they complete,

If a client books their driving test before consulting with their instructor, Go Hamilton Drive School reserves the right to withhold the School’s car/s for a driving test if the Instructor has let the client know they haven’t yet reached a level of independent competency that is required to take and pass the test.

Go Hamilton Drive School reserves the right to refuse their services in the circumstances below:

  1. The client hasn’t paid for lessons (see further payment terms below)

  2. The client regularly cancels lessons on a regular basis without giving the required notice.

  3. The client refuses to pay a cancellation fee on cancelling a lesson.

  4. The client makes unreasonable demands, i.e. time of lessons, the amount of lessons taken per week.

Payments

  1. The client will be supplied with details of driving lesson fees before or at their first lesson. The client will always be notified of any change to driving lesson fees 4 weeks in advance of the change.

  2. All driving lessons must be paid for 24 hours in advance or at the very beginning of the driving lesson.

  3. Payments may be made by cash, debit card or bank transfer and must be  paid directly to Go Hamilton Drive School which ensures the agreement and the responsibility for the provision of driving lessons is with Go Hamilton drive school.

  4. The client will accept that any lessons paid for in advance directly to the driving instructor results in the agreement and responsibility for the provision of driving lessons being directly with the instructor.

  5. Go Hamilton Drive School does not provide credit facilities under any circumstances and driving lessons will only take place when payment is received in advance. If payment hasn’t been received within the conditions set out Go Hamilton Drive School and its instructors reserve the right not to carry on with the arranged lesson.

  6. Go Hamilton Drive School reserves the right to change prices and payment plans and charge clients at a new price rate, which will always be communicated to the client 4 weeks in advance.

  7. If a client hasn’t communicated with Go Hamilton’s Drive School for 2 months we reserve the right to charge at a new rate or discontinue lessons.

Cancellations:

  1. The client must give 48 hours notice when cancelling a driving lesson, otherwise the driving lesson will be charged in full at the normal rate. This includes reducing the length of a driving lesson without prior agreement.

  2. If a client needs to cancel a lesson, they must confirm by text to their Go Hamilton Drive School instructor.

  3. Where a client repeatedly cancels lessons, we reserve the right to:
    1.Impose a longer period of notice required for the cancellation of driving lessons.
    2. Insist on prepayment for all driving lessons.
    3. Discontinue driving lessons with the client.

If a client has booked a single day of intensive lessons (four hours or more) and needs to cancel for any reason, the cancellation must be confirmed by the client at least 5 full days beforehand otherwise the lessons will all be charged in full. 

There are occasionally reasons why a lesson may need to be cancelled by Go Hamilton Drive School at short notice, for example if the weather is adverse, the instructor’s car is in need of repair, the instructor is unwell or there is another emergency or unforeseen circumstance. We will inform you of this as soon as possible. 

Should a booked driving test be cancelled due to an issue with the instructor’s car, the instructor is ill or for any other reason on the behalf of the instructor then the instructor will reimburse the equivalent of the amount paid for that test towards the next driving test. This is only applicable if the client was not given sufficient notice to cancel their driving test without losing the driving test fee.

Refunds

1. Refunds will only be paid to clients under special or extenuating circumstances and at the goodwill and discretion of Go Hamilton Drive School.

2. When a client has paid in advance for driving lessons, they shall be entitled to a refund at any time for unused driving lessons providing they have given notice to stop with the required period of notice.

3. Refunds can be paid if there is proof of terminal illness, death of a family member or other extraordinary circumstances such as moving out of the country.

5. Refund requests must be sent in writing via email to Gohamiltondriveschool@gmail.com

6. The instructor has 1 month to issue refunds, starting from the date of requested refund.

7. Where a refund is requested and granted and the client has received a discount for the prepayment of driving lessons, the client will be charged for lessons already taken at the normal driving lesson rate and refunded the remaining balance they have paid for future lessons in the package. This does not apply to short notice cancellation (less than 48 hours notice prior to the lesson).
